What a nice, tolerant and completely unbiased post you brought us here.

This sees both paries happy, but no matter what we say and do there will always be the people who moan, and thats mainly because they dont understand enough.

Maybe what you called moaning does come from understanding enough? Understanding that by the current mechanics PvP'ing does not have consequences for those who take part, nothing to lose? Understanding that those who take part can only gain? Understanding that those who don't take part can only lose? Understanding that there is no place for any peaceful role by the current mechanics?
Those who criticize these current mechanics usually only ask to why that part is restrictive in the way it is, why it is unbalanced the way it is. That doen't state that the critics wouldn't enjoy participating, in fact most do. The ones who favor these mechanics usually jump on that and repeat what has been critized by bringing the ever-old and really tiresome argument of "eat or die", "take it or leave it".
Why don't they just for once begin to see that nobody wants to take their lollypop away, that everybody's only trying to make it taste better -for all?
Instead you wish to end the "stupidity and arguments" by shutting the rest up... You're talking about free choice, but by this try to deny it to those who don't agree with you. Is it only me who imagines a crying child yelling "Mine! Mine! Mine!"? (A counterpart who keeps on yelling "You can't have it!" is no way better, btw...)
Why does everybody always "know" what's the best for all?
Why does everybody always insist that their way to play is THE way to play?
I'm growing real tired of it.
