My character seems to swim under the water surface?

Anyone else having this small issue?

I have:
- Ati Radeon 9700 pro AGP (0x4E44) with driver version 6.14.0010.6542 (English).
- Windows 2000 Professional (5.0, Build 2195) Service Pack 4 with DirectX 9.0c (4.09.0000.0904).
