Eh, so before you make yourself look even more silly ... you do realise that the phoenix animation is shown in several OFFICIAL trailers, posted on main Ryzom website, right? In some of those vids casters use nothing else then phoenixed fire spell.

As far as I know no modification of client files are needed to "achieve" this kind of effect, you could aswell ban everyone who uses a skin on winamp.

to get the desired effect to display unofficial spell animation in game, one breaks EULA. 14. RULES OF BEHAVIOR. that states (among other things)

The User is therefore strictly forbidden: (a) to use any program or method to change the content or functionalities of the Game;

Oh, thats it. When the files are placed on his hard drive, they become his property. Plain and simple. No EULA can sign away rights of a consumer.

This is true in the US, not sure about elsewhere:
A citizen of the US cannot sign away his rights, regardless of the terms of a contract. You can make agreements, but when it comes down to it, you are still protected by them. This is why they are called rights. The EULA is unconscionable at best, and completely illegal at worst. Any lawyer will tell you they are only as valuable as the paper they are printed upon(or in this case, the medium they are stored on).

Its terms do not nullify the fact that the users has OWNERSHIP of the files on his or her system. They may not have rights to the Intellectual Property, or rights to sell or distribute them, but they can do whatever they please with them on their computer.
